Decodation LLC d/b/a TimeStub (“us”, “we”, or “our”) operates the timestub.decodation.com website and the TimeStub web and mobile applications. We respect your privacy and are committed to protecting your personal information. This Privacy Policy describes how we collect, use, and share information about you when you use our website and mobile applications (collectively, the “Service”).  By accessing or using our Service, you represent and warrant that you accept the policies and terms described in this Privacy Policy. At our Service, we are committed to protecting the privacy and security of our users. Device Information: We may collect information about the device you use to access our App and Website, including the device type, operating system, and browser type.

Log Data

We may also collect information that your browser sends whenever you visit our Service or when you access the Service by or through a mobile device (“Log Data”).

This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics.

When you access the Service by or through a mobile device, this Log Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use and other statistics.

In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase our Service’s functionality. These third party service providers have their own privacy policies addressing how they use such information.

Location Information

We may use and store information about your location depending on the permissions you have set on your device. We use this information to provide features of our Service, to improve and customize our Service. You can enable or disable location services when you use our Service at anytime, through your mobile device settings.

Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and transferred to your device. We use cookies to collect information in order to improve our services for you.

If you are located outside United States and choose to provide information to us, please note that we transfer the information, including Personal Information, to United States and process it there.

Children’s Privacy

Only persons age 18 or older have permission to access our Service. Our Service does not address anyone under the age of 13 (“Children”).

We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you learn that your Children have provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from a children under age 13 without verification of parental consent, we take steps to remove that information from our servers.

Your Choices:

You can opt-out of receiving promotional emails from us by following the instructions in the emails we send. You can also opt-out of our collection of location information by changing the location settings on your device.

Updates to this Privacy Policy:

We may update this Privacy Policy from time to time. We will post any updates to this Privacy Policy on our App and Website, and the updated Privacy Policy will be effective when posted.

Additional Information for California Residents

This section supplements the information and disclosures contained in our Privacy Policy, and applies to individuals residing in California from whom we collect personal information as a business under California law.  In this subsection, we provide California residents with additional information regarding our collection, use and disclosure of their personal information, as well as their privacy rights, as required by the California Consumer Privacy Act (“CCPA”). This section does not address or apply to our handling of publicly available information or other personal information that is exempt under the CCPA.

Sales and Sharing of Personal Information.  California privacy laws define a “sale” as disclosing or making available to a third-party personal information in exchange for monetary or other valuable consideration, and “sharing” broadly includes disclosing or making available personal information to a third party for purposes of cross-context behavioral advertising.  While we do not disclose personal information to third parties in exchange for monetary compensation, we may “sell” or “share” (as defined by the CCPA) identifiers, internet and other electronic activity information and inferences to advertisers, analytics providers and third-party platforms and social networks.  We do so in order to improve and measure our ad campaigns, reach users with more relevant ads and content, and for analytics and research purposes.   We do not sell or share sensitive personal information, nor do we sell or share any personal information about individuals who we know are under sixteen (16) years old.

Notwithstanding the above purposes, we only use and disclose sensitive personal information as reasonably necessary (i) to perform services requested by you, (ii) to help ensure security and integrity, including to prevent, detect, and investigate security incidents, (iii) to detect, prevent and respond to malicious, fraudulent, deceptive, or illegal conduct, (iv) to verify or maintain the quality and safety of our Services, (v) for compliance with our legal obligations, (vi) to our service providers who perform services on our behalf, and (vii) for purposes other than inferring characteristics about you.  We do not use or disclose your sensitive personal information other than as authorized pursuant to section 7027 of the CCPA regulations (Cal. Code. Regs., tit. 11, § 7027 (2022)).

Retention.  We retain the personal information we collect only as reasonably necessary for the purposes described above or otherwise disclosed to you at the time of collection.  For example, we will retain your account data for as long as you have an active account with us.  We also maintain the personal information we collect in order to comply with our tax, accounting and recordkeeping obligations, for research, development and safety purposes, and for an additional period of time as necessary to protect, defend or establish our rights, defend against potential claims, and comply with our legal obligations.

b. CCPA Privacy Rights

If you are a California resident, subject to certain limitations, you have the following rights regarding your personal information:

Know/access: You have the right to obtain information (up to twice per year) regarding the: (1) categories of personal information collected, sold, or disclosed by us; (2) purposes for which categories of personal information are collected or sold by us; (3) categories of sources from which we collect personal information; (4) categories of third parties with whom we disclosed or sold personal information; and (5) specific pieces of personal information we have collected about you during the past twelve months.

Delete: You have the right to to request deletion of your personal information maintained by us.

Opt out of sales and sharing: You have the right to opt out of the sale and sharing of your personal information by us.

Limit certain uses and disclosures of sensitive personal information: You have the right to limit the use and disclosure of your sensitive personal information to those authorized pursuant to the CCPA. However, as explained above, we do not use and disclose sensitive personal information about California residents beyond these authorized purposes.

Correct: You have the right to correct inaccurate personal information that we maintain about you.

Non-discrimination: You have the right to not receive discriminatory treatment for exercising your CCPA privacy rights.

Submitting CCPA requests to know/access, correct and delete. California residents may submit verifiable requests to access/know, correct and delete their personal information maintained by us by calling our toll-free number (208) 615-2908.  So that we may verify your request, please provide us with your current name, email address, and phone number in your request and we will reach out to you to obtain additional information, if necessary. We will process your request based upon the personal information in our records that is linked or reasonably linkable to the information provided in your request. If we are unable to adequately verify a request, we will notify the requestor.  Authorized agents may initiate a request on behalf of another individual by contacting us and providing a written authorization from the consumer.  Authorized agents will be required to provide proof of their authorization, and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.

c. Rights Under California’s “Shine the Light” Law

California residents may also request information, once per calendar year, about our disclosures of certain categories of personal information to third parties for their direct marketing purposes (if any). California Applicant Privacy Notice

This California Applicant Privacy Notice (the “Notice”) is provided by Call List, Inc. and its subsidiaries (“Call List,” “we” or “us”), pursuant to the California Consumer Privacy Act (Cal. Civ. Code § 1798.100, et seq.), as amended by the California Privacy Rights Act of 2020, and its implementing regulations (“California Privacy Law”).  In this Notice, we describe our collection and processing of personal information related to current and former job applicants, candidates and prospective employees who are residents of California (each an “Applicant”), as well as the rights these Applicants have regarding their personal information. 

1. Scope

This Notice applies only to the personal information that Call List collects related to California Applicants and is intended to satisfy Call List’s applicable notice obligations under the CCPA. We may also provide additional notices to Applicants about our data collection practices that are covered by other laws (such as if we conduct a background check).

This Notice does not address or apply to our collection of personal information that is not subject to the CCPA, such as (i) protected health information, consumer credit reports and background checks, publicly available data lawfully made available from state or federal government records, or other information that is exempt under the CCPA; (ii) the personal information that we collect about Applicants and other individuals who are not residents of California; or (iii) the personal information we collect from employees, contractors, officers and directors, which is subject to other notices and not this one.

Retention.  We retain the personal information we collect only as reasonably necessary for the purposes described below or otherwise disclosed to you at the time of collection. For example, we will retain your information as necessary to comply with our tax, accounting and recordkeeping obligations, to consider you for additional positions, as well as an additional period of time as necessary to protect, defend or establish our rights, defend against potential claims, and comply with our legal obligations.

Purposes for Processing Personal Information. Subject to applicable legal restrictions, generally, we collect, use, disclose and otherwise process Applicant personal information for the following business and commercial purposes:

Recruiting, hiring, managing and evaluating Applicants: to review, assess, recruit, consider or otherwise manage the recruiting process and job applications, including:

Scheduling and conducting interviews;

Identifying potential candidates, including by working with external recruiters;

Reviewing, assessing and verifying information provided, to conduct criminal and background checks (where relevant and pursuant to applicable law), and to otherwise screen or evaluate Applicant qualifications, suitability and relevant characteristics;

Extending offers, negotiating the terms of offers and assessing salary and compensation matters

Defending and protecting rights: to protect and defend our rights and interests and those of third parties, including to manage and respond to legal claims or disputes (including Applicant claims and disputes), and to otherwise establish, defend or protect our rights or interests, or the rights, interests, health or safety of others, including in the context of anticipated or actual litigation with third parties.

Complying with legal obligations: relating to compliance with applicable legal obligations (such as hiring eligibility, responding to subpoenas and court orders) as well as assessments, reviews and reporting relating to such legal obligations, including under employment and labor laws and regulations, Social Security and tax laws, environmental regulations, workplace safety laws and regulations, and other applicable laws, regulations, opinions and guidance.

We do not use or disclose Applicant sensitive personal information for purposes beyond the permissible purposes authorized by the CCPA.  In general, our use and disclosure of Applicant sensitive personal information is limited to what is reasonable and proportionate for the following purposes: (a) to comply with our legal, regulatory and reporting obligations; (b) to provide services requested by you, to respond to your requests, to make reasonable accommodations where necessary, and to verify the information you provide to us; (c) to manage and administer the application and hiring process and communicate with Applicants; (d) in support of our equal opportunity and diversity and inclusion efforts (on a voluntary basis); (e) to protect the health and safety of an individual; (f) to protect and defend our rights; (g) to prevent, protect and take action against malicious, deceptive, fraudulent, or illegal actions, and security incidents. 

Sales and Sharing. We do not ‘sell’ or ‘share’ for ‘cross-context behavioral advertising’ purposes (as defined by the CCPA) any Employee personal information (including about individuals we know are minors).

California Privacy Rights

CCPA Rights of Applicants. Subject to certain limitations and exceptions, Applicants (who are residents of California) generally have the following rights under the CCPA with respect to their personal information collected and processed by us:

Right of deletion: to request deletion of their personal information that we have collected about them and to have such personal information deleted (without charge), subject to certain exceptions.

Right to know (access): to request that we (i) disclose the categories and sources of personal information we have collected about them, the categories of personal information disclosed, sold and shared, the categories of third parties to whom we have sold, shared or disclosed such personal information, and the business or commercial purposes for which we collect, use, disclose and process their personal information, and (ii) provide them with a copy of the personal information we have collected about them (in a portable format to the extent practicable).

Right to correct: to request that a business that maintains their inaccurate personal correct that personal information. 

Right to non-discrimination: to not to be subject to discriminatory treatment for exercising their rights under the CCPA. 

Submitting CCPA Requests. Applicants may exercise their CCPA rights by submitting a Privacy Request online here or calling our toll-free number (208) 615-2908.  We will take steps to verify your request by (i) sending a confirmation email to your email address on record with us (which you must take action to confirm); and (ii) matching the information provided by you with the information we have in our records.  You must complete all required fields on our webform (or otherwise provide us with this information if you submit your request via telephone) to verify your request.  In some cases, we may request additional information in order to verify your request or where necessary to process your request. If we are unable to adequately verify a request, we will notify the requestor.  Authorized agents may initiate a request on behalf of another individual through one of the above methods; authorized agents will be required to provide proof of their authorization and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.
